California Proposition 65, also known as the Safe Drinking Water and Toxic Enforcement Act of 1986, is a law that requires businesses to provide warnings to Californians about significant exposures to chemicals that cause cancer, birth defects or other reproductive harm. The law requires the state to publish a list of chemicals known to cause cancer or reproductive toxicity, and businesses must provide a 'clear and reasonable' warning before knowingly and intentionally exposing anyone to a listed chemical. This warning can be given by a variety of means, such as by labeling a consumer product, posting signs at the workplace, or publishing notices in a newspaper. The purpose of Prop 65 is to help Californians make informed decisions about protecting themselves from exposure to these chemicals.
Considering most U.S. companies conduct business in California (just like us at Skullcandy!), chances are you’ve seen the Prop 65 warning label on many household products you already own, even if you don’t live in California. None of Skullcandy’s products are made with any specifications that include hazardous or cancer-causing chemicals. Skullcandy does testing of its products to ensure that it is safe from these chemicals. However, because it is possible that, as a result of chemical reactions or raw materials sourcing by our suppliers, a product could inadvertently contain a chemical listed by California, Skullcandy includes the Prop 65 warning on this product website.
We include this disclosure on the products website to ensure that there is a safe harbor in place in the event that there is a potential hazardous substance that unintentionally appears in a product as part of the manufacturing process — however, this is meant to inform our customers and does not mean that the Skullcandy product is unsafe.
